With respect to the
multiwall polycarbonate sheets, A & C Plastics Inc. warrants
the following for 10 years:
a) For a period of ten years
from the original purchase date of the sheets, the
deterioration of the degree of transparency will
not be higher than 6% according to ASTM 01003 in
comparison with the original sample.
b) The degree of yellowing according to ASTM 01925
will not change more than 10 delta in comparison
with the original sample within 10 years from the
original purchase date.
c) During the guarantee period, hail will not break
multiwall sheets. Breakage caused by hail is when
at least one of the surface walls shows holes caused
by hail.
This warranty does include a clause
against breakage caused by hailstones which has been
developed according to tests run on our sheets. Artificial
hailstones with a diameter of 20 mm have been shot
against the surface of the sheet with a speed of 21
m/s and no breakage occurred under these testing conditions.
The optical characteristics mentioned
at [a] and [b], above, refer to clean and scratch
free samples.
2. The warranty period is limited
to 10 years from the time of purchase of the sheet
material from A & C Plastics Inc..
3. The extent of A & C Plastics Inc.’s
warranty obligation is restricted as follows:
a) A & C Plastics Inc.
is, at its discretion, obliged to replace all
the defective material FOB. Houston, TX or Colorado
Springs, CO (whichever branch the material was shipped from)
or to reimburse the price to
the buyer.
b) This warranty does not include re-installation
or fabrication expenses or any other direct or indirect
loss which may result from sheet failure, improper
storage, neglect or misapplication of the product.
c) This warranty does not apply to sheets that
have been formed, molded or heat treated.
4. This manufacturer’s
warranty is only valid within North America.
5. This manufacturer’s warranty will become
valid only if:
A & C Plastics Inc. when asserting claims resulting from this
warranty.
a) the end user gives written notice presenting
the invoice and submits samples of the defective
sheet which include the code shown on the outer
face of the sheets within one week after the defect
was noticed.
b) the end user has allowed an inspection by A & C Plastics Inc..
c) the defective sheets were kept in stock, transported,
processed, and installed in accordance with the
technical information which A & C Plastics Inc. provided.
d) the sheets were used under normal conditions.
e) the sheets were no longer kept in place after
the defect occurred.
6. This warranty is void if the
defect was caused by improper handling. Such improper
handling within this meaning shall be any non-compliance
by the end user with the following provisions:
— The thickness of multiwall
sheets installed, must be at least 5 mm;
— multiwall sheets must be protected against
exposure to chemicals;
— When using multiwall sheets, scratching and
denting is to be avoided;
— Incompatible connecting, fixing and tightening
elements are not to be used;
— Neither incompatible adhesives nor incompatible
sealing compounds are to be applied;
— When cutting multiwall sheets, heat and compression
are to be avoided;
— multiwall sheets must not be exposed to sources
of heat;
— The U.V. protected (coextruded) surface
of multiwall sheets must be faced towards the sun;
— multiwall sheets are not to be exposed to
adverse weather conditions on both sides;
— The bending radius may not be less than
150 times the sheet thickness;
THE
WARRANTIES STATED HEREIN ARE IN LIEU OF ALL OTHER WARRANTIES,
WRITTEN OR ORAL, EXPRESSED OR IMPLIED, INCLUDING
ANY WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE. ANY OTHER
CLAIMS FOR DAMAGE OR
LOSS EITHER DIRECT, INDIRECT OR CONSEQUENTIAL,
WHATEVER THE CAUSE THEREOF,
ARE EXPRESSLY EXCLUDED FROM THE WARRANTY. A & C
PLASTICS INC.'S SOLE OBLIGATION
SHALL BE LIMITED TO REPLACING THE SHEET OR REFUNDING
THE ORIGINAL PURCHASE
PRICE, AT ITS OPTION, WHICH SHALL BE YOUR SOLE
AND EXCLUSIVE REMEDY.
UNDER NO CIRCUMSTANCES SHALL A & C PLASTICS
INC. BE LIABLE FOR ANY AMOUNT GREATER THAN THE PURCHASE PRICE OF THE SHEET.". |
